Below is our recent interview with Mike A. Miglio, Partner at Wolfe Miglio:

Q: Could you provide our readers with a brief introduction to Wolfe Miglio?

A: Wolfe Miglio is a boutique law firm that specializes in “cryptocurrency law”, which is the amalgamation of various other fields of law that touch on or affect digital assets (coins, tokens, crypto securities) and digital asset exchanges. We began to focus on cryptocurrencies back in 2017, and were one of the first legal service providers in the world that catered cryptocurrency clients. Since our establishment we have served dozens of startups in the cryptocurrency space and have aided in a truly diverse host of legal issues that span criminal law, securities law, real estate law, business law and international law; now, Wolfe Miglio caters to some of the world’s top 100 cryptocurrency companies.

Q: Mike, can you tell us something more about your background? How did you get involved in the cryptocurrency industry?

A: In the beginning, my cryptocurrency trading life and my attorney life were separate. I had been following bitcoin since 2012 back when Silk Road was the only thing that the general public associated with Bitcoin, but I didn’t start heavily investing and trading in cryptocurrencies until 2016. In 2017, it became apparent to us that there was a growing need for legal services in the cryptocurrency space and nobody in the space really understood how or when the law affected their crypto businesses or personal holdings, so we launched our firm. My love for the law and cryptocurrency technology have been happily married ever since.

Q: What types of services do you offer to your clients?

A: Most of our clients are startups and projects that want to utilize cryptocurrency technology to raise investor capital, so the majority of our services cater to these individuals. General guidance and advice, securities and commodities compliance, due diligence, contract drafting, government filing, corporate structuring, bank account formation, digital asset model advice and strategic networking are the services we provide most of the time; however, a full history on the services we have provided and will continue to provide are too long to list here.

Q: What are the legal issues surrounding cryptocurrency industry?

A: This question is deceptively broad–several volumes of books could be written trying to answer it, and in a year from now most of the information would be obsolete. In a nutshell, most of the problems that face cryptocurrency today stem from how different countries (and different jurisdictions within countries) treat and classify digital assets. A token may be a commodity, a security, and unregulated all at the same time depending on which country’s laws you are comparing the asset to. Combine this lack of clear treatment with the fact that most projects have owners, employees, staff, and investors in multiple different countries, and it becomes very difficult to discern which laws a project is required to adhere to, and certainly impossible to adhere to them all.

The problems become exponentially more complex when you take into account the many different characteristics that tokens and their offerings can have.

Q: What are your plans for the future?

A: The firm is heavily focused on geographically expanding so that we can better suit our clients. Most of our work is time sensitive, and clients need to be able to reliably get in touch with their lawyers on short notice in order to close deals or prevent disasters. To this end, we have Michael Miglio in Houston, Adam Wolfe in Tokyo, Lily Feng between China and New York, and several other employees throughout the United States. Our next step is to secure a few knowledgeable partners in Europe that we are confident can service our clients with the same level of care and promptness that they have come to expect from our very dedicated team.
