Q: What are your thoughts about patent analytics and their potential to assist IP practitioners with patent prosecution?

A: Before the introduction of patent analytics, patent professionals had to essentially work from the gut. For example, there was no concrete data about which art units were relevant, how their rejections compared to the industry average or where the potential weaknesses might be with each patent submission. Now, patent analytics allow for more strategic patent prosecution which can result in lower prosecution costs while facilitating the prosecution of higher quality patents. For example, knowing your patent examiner generally grants patents quickly and has a low average number of office actions, can tell you not to negotiate too heavily but rather to work to retain broader claims. Moreover, patent drafters can quality check their patent claims and analyze specific claim elements so that they can find items within their claims that are too vague, lack sufficient support in the disclosure or have been adjudicated in a patent related decision. In addition, patent analytics are useful for patent prosecutors because they can provide automated detection of claim anomalies, improper recitations and suggest better, more appropriate language. Another application for patent analytics is it can also help companies evaluate how their legal counsel is performing against their peers. Firms can use this information to compare their performance against competitors when marketing their services. These examples are just a few of the growing list of ways to apply patent analytics. In short, patent analytics are a breakthrough in the patent world because they help drive better, more predictable outcomes while decreasing costs.

Q: Can you give us a glimpse into your future product development plans at LexisNexis IP Solutions?

A: We have a number of product enhancements and new tools on the way that will make our offerings even more robust and valuable for patent professionals. For example, now that we’re seeing a little bit of a thaw for Alice applications, we’ve developed LexisNexis Custom Reports for Alice. These are custom reports that review a company’s Alice applications and suggest ways to help patent prosecutors overcome §101 objections.
